Murder trial calls on DNA testing

MANTORVILLE — Monday, a forensic scientist authenticated DNA findings taken from evidence collected at the scene where Troy Ulrich was killed in February 2008.

Bureau of Criminal Apprehension Forensic Scientist Rachel Ford testified at the trial of Danny Ortega Jr., 22. Ortega Jr. and his father Danny Ortega Sr. are charged with stabbing and beating Ulrich to death at the apartment grounds where all three men lived in Claremont.

Both Ortega men face charges of first-degree murder, first-degree murder while committing a felony, second-degree murder with intent, and second-degree murder without intent while committing a felony.

Ford, along with other BCA investigators and forensic scientists testified to the process of collecting evidence from the scene, which included the knife used in the attack, shoes and clothing worn by both Ortega men that was left in a dumpster outside the apartment building.

A sweatshirt belonging to Ortega Jr. and a pair of jeans, shirt and undershirt belonging to Ortega Sr. were found in the grocery bag.

Blood spots on a sweatshirt found in the trash bin belonging to Ortega Jr. matched Ortega Sr.’s DNA.

Lead forensic scientist, Mark Nielson testified that the clothing was damp when found. The items were dried then put back into the bag to preserve evidence the way it was found.

When asked by defense attorneys, Nielson and Ford testified that yes, blood and DNA can be transferred from clothing to clothing. The DNA of Ortega Sr. could have transferred to Ortega Jr.’s sweatshirt.



DNA from Ortega Sr. was found on bolt cutters allegedly used in the attack. A mixture of DNA profiles belonging to both Ortega Sr. and Ulrich were found on Ortega Sr.’s jeans. Only DNA of Ortega Sr. was found on the two shirts belonging to Ortega Sr. He was hit in the head and lost a tooth during the fight with Ulrich.

Troy Ulrich’s DNA was found in blood spots on Ortega Jr.’s shoes which matched tracks found in blood stains inside the garage where Ulrich was slain.

Testimony provided by Melissa Lane, then Ortega Jr.’s girlfriend, stated Ortega Sr. washed the knife off in his bathroom sink with bleach. Tests showed there may have been blood on the knife but tests could not find enough DNA evidence to create a profile.

Earlier in the day, an attorney for Severo Ortega and his girlfriend Rosa Ramirez said Ortega would only testify to the information he gave investigators at the time of the incident. Ramirez, who has been identified by other witnesses as the woman who drove Ortega Jr. to Austin where he was arrested the day after the murder, would exercise her Fifth Amendment right as to not implicate herself in any crime.

Rosa did not testify Monday. Severo Ortega is Danny Ortega Jr.’s grandfather and rented the apartment where Ortega Jr. lived at the time of the killing. Ortega answered limited questions by the prosecution Monday.

Testimony is scheduled to continue at 9 a.m. today.

All this over drugs. I wonder what makes people start with drugs, alcohol, and tobacco despite the warnings. Peer pressure? Depression? Low self esteem? It is a known fact that some people choose this route to hide other issues like depression or family problems. They choose to avoid treatment because they feel “I’m just fine, there’s nothing wrong with me”. However, if they stop using drugs, tobacco, or alcohol, they would go crazy. I know people who admit they have depression issues and choose to do nothing about it so they continue to drink. To anyone else who is reading this, what made you try your first cigarette, beer, or illegal drug? Even though you knew it was bad, you still tried it. Why?

Reading how some people are continually harping on the fact of how bad drugs are and saying "I just don't get it" make me want to go bobbing for Vicodan in a vat of Jack Daniels while eating some special brownies. But I'm kinda weird like that.

I smoked my first cigarette when I was 9 because I was clinically depressed. I was depressed because I was hopelessly addicted to alcohol and barbituates. When I was 11, I discovered sex while in a nicotine rehab center in New Jersey with my female counselor and eventually married her at the age of 16.
We had thirteen kids, all of whom are currently holding masters degrees they earned while in prison for drug convictions.
Now they support me and I spend my days here, sharing my life experiences in the hope that someone will see in my comments a ray of hope that they too can overcome the evils of tobacco.

I have. Maybe you should go back a few days and read my posts in previous articles. But apparently you think your Uncle’s association with the Ortega’s had nothing to do with getting himself killed? Like I mentioned before, if he had never associated with them in the first place he would still be alive.

None the less, at least my lifestyle of not using drugs, alcohol, or tobacco has allowed the family business to succeed. My husband and I will be retiring in about 3 years. Not too bad for being just short of 40 years old. You can all spend your money on noisy motorcycles, beer, and biker rallies, all while working an hourly rate for life. The world does need dishwashers too!!

G.Q. - No thanks. Your comments have been nothing but very rude and very opinionated. I don't care to re-read anything or read anything more from you. We all have our opinions, but there is also a time & place for it.

No offense, but if you don't believe in God, heaven or hell, that helps me understand why your seem to be such a cold, callus person and don't give a hoot who your hurting in the process. Family who reads the articles on this trial. Even if Mr. Ulrich's kids are reading this stuff, you just don't care.

You continue to try to be the center of attention and that is so sad. I feel very sorry for you.

JJCHCA- I, too, was close with Troy and still am very close to his family. I agree with you. This is supposed to be where friends, family and anyone else would like to express their condolences.

However, when someone is constantly talking about how much of a drug user Troy was and blah, blah, blah, we all feel the need to speak up since he cannot defend himself.

I am done talking with GQ as I will NOT feed into her negativity anymore. After all, its attention that she's looking for.

GQ you just corrected someone on their spelling...Hmmm I seem to recall you making a comment to someone when they corrected yours. I think the words you used were..."you can't think of anything to say so you jump on the grammar and spelling wagon" or something to that extent. Contradict yourself much? As far as someone knowing the drug and alcohol lingo and all the problems we have in the world because of it, I don't think you have to experience it to in order to see what it's done to people. Just turn the tv on. Or stay naieve if that's what you choose. All of us are giving her what she wants: attention. I pity you and I have nothing more to say to you about it. If we all do that maybe she'll shut her mouth. Her ignorance is not blissful anymore, it's a waste of time.
